Has anyone done this before? Do you just contact the dude, like say, Art Blakey and ask if you can use their sample?
And do they ask for money?

yeah or the record label that owns the music when it comes to sampling a sound off of a record, its never like the artists sue the person, its always the people who own the music........i'd like to think that art blakely would probably be down with you sampling his shit.

i tried once but never got a reply. i emailed them. and they refuse to answer. so i sold the track and made a billion dollars. im now being sued two million. NOW THATS WHAT I CALL CLEAR

as for the very thing of clearing samples - I dont know nothing about the process.

But Im pretty sure that, as long as we aint selling thousand's of copies of our albums, we shouldnt have much problems with the whole sample clearance thing.

Few days ago I read an article on unkut.com entitled "Six Reasons Why Hip-Hop Will Win In 2010".

The first reason is:

I guess guys are pretty right about that.

Yeah, gotta agree with Elhuana. If you're a small time producer, they won't fuck with you. They want that Jay Z status type of producer with the millions to cough up the dough. It better business that way and less dough to spend on lawyers for every beat maker they hear with their sound.

BUT...copyrights is an issue, because they won't just let that go by. They will ask for agreements for samples and your shit won't be certified. And if someone hears and bites your stuff you can't do jack without licenses and permission, plus copyright certificates. So its a win/lose situation.

i'm no lawyer, but i would guess; just keep good records of income made. that way, if you do blow up you can't be sued for more than you made. of course, if you're sampling M. Jackson (rip) then you in trouble. but if it's someone long since forgotten or small enough that tey're happy just to get extra exposure then you will probably be able to work something out after the fact.

it would be done through record labels or perhaps agents, unless the guy owns the rights to their own shit (not common back before digital distribution)
